Alina Habba steps down following judicial rules against her.
The former personal attorney for Donald Trump has stepped down as the US Attorney for New Jersey. This decision was prompted by a legal ruling that invalidated her right to serve.
Official Departure
The nation's top law enforcement official, the Attorney General, accepted the prosecutor's departure on the start of the week. She commented that the court's "flawed" ruling made it "untenable" for Habba to lead the department effectively.
"Let no one confuse following the order as giving up," she declared. "This battle will now reach across America."
Court Ruling
Habba's exit comes a week after a federal appellate panel determined that she had been serving in violation of the law as US attorney. This ruling is expected to impact many criminal cases in the Garden State.
The appellate judges declared that a temporary posting that skirted the advice and consent of the Senate breached the Federal Vacancies Reform Act.
Ongoing Legal Battle
It was also stated that Habba will stay on at the DOJ as a top consultant. They intend to pursue additional appeals of the disqualification, with hopes of a reversal.
In a statement, she argued that the court "should not be able to second-guess the President's choice of lawyers tasked with executing the executive branch's core responsibility of criminal prosecution."

Connection to Donald Trump
Habba, was initially recruited to Trump's personal legal team in recent years. Subsequently, she defended her client in his hush-money trial in 2024, when he was conviction on 34 counts of financial record manipulation.
Prior to Habba took on the top New Jersey post, Trump had revealed he was appointing her as his White House advisor if re-elected, calling Habba as a steadfast ally and a "tireless advocate for justice".
