Federal Judge Mandates Freedom of Abrego Garcia from Immigration Custody

Courtroom proceedings

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks lawful basis.

"Since his release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.

The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to answer human smuggling allegations, he was detained in federal custody.

In her order, the court pointed out that the government does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal challenge center on disputed assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in the state of Tennessee.

Conditions of Freedom

The judge, who was hearing his challenge to deportation in a federal court, determined that he must now comply with the terms of his release from custody in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.

This ruling marks a notable development in a complicated immigration case involving allegations of wrongful detention and contested criminal associations.
